San Diego & Orange County Restaurants Involved in Alleged Wage Infraction That Settled Million Dollar Lawsuit

Irvine, CA: A landmark settlement was announced on Tuesday after eight Cheesecake Factory restaurants in San Diego and Orange counties were involved in wage infraction that affected as many as 589 janitors working at those places.

The Cheesecake Factory contracted and subcontracted for the employment of those janitors.

The settlement was followed by an investigation that began in 2016 into alleged wage and hour violations at the reporting sites.

Workers were frequently accumulating up to 10 hours of unpaid overtime each week, and some worked without sufficient meals or rest periods.

The investigation focused on the following Cheesecake Factory restaurants that were involved:

  • Spectrum Center Drive, Irvine.
  • Brea Mall Way, Brea.
  • Harbor Drive, San Diego.
  • Newport Center Drive, Newport Beach.
  • Edinger Avenue, Huntington Beach.
  • The Shops at Mission Viejo, Mission Viejo.
  • Via Rancho Parkway, Escondido.
  • Friars Road, San Diego.

Janitors who worked at those locations between August 31, 2014, and August 31, 2017, were asked to contact the Labor Commissioner’s Office at 619-767-2039, as they may be eligible for compensation and damages as part of the settlement.

“California strengthened its laws to remove loopholes that allowed businesses to subcontract services and avoid responsibility to ensure workers are paid what they are owed,” California Labor Commissioner Lilia García-Brower said in a statement.
