TAVARES, Fla. – The 5th Judicial Circuit State Attorney’s Office announced Thursday that it will seek the death penalty against a Tavares mother and her boyfriend, who are accused of the brutal murder of her 10-year-old son, Xavier Williams.
Kimberley Mills, 37, and Andre Walker, 36, were arrested in February after bringing Xavier to the hospital. Police said the boy was covered in bruises, burns, and other injuries consistent with severe abuse. He died weeks later.
Initially charged with second-degree murder and aggravated child abuse, the couple was later indicted by a grand jury on five counts each, including first-degree felony murder. Prosecutors say evidence—including a ladder, a 10-pound weight, and duct tape—indicates the boy and his younger brother endured horrific abuse.
Authorities believe Mills and Walker left the hospital after dropping Xavier off, only to return to their home for a “hasty cleanup” before law enforcement arrived.

At a news conference, State Attorney Bill Gladson said the case qualifies for the death penalty under Florida law.
“Florida law allows for capital punishment for the most heinous of crimes and for the most vulnerable of victims, and that’s what we have in this particular case,” Gladson stated.
Tavares Police Chief Sarah Coursey echoed the sentiment, calling the decision “a solemn response born out of respect for Xavier and his family.”
Xavier’s aunt, Cameil Wilson, said the family is relieved by the decision, though the process has been difficult.
“It hasn’t been a joyous occasion, but we are pleased with the news we’ve had today,” Wilson said.
Mills and Walker remain in custody as they await trial.
