NYPD Officers Charged with Burglary and Official Misconduct After Allegedly Groping Prostitute in Queens

New York City: After responding to a 311 call at an infamous Queens prostitution ring known as the “Market of Sweethearts,” two NYPD officers touched a prostitute and took her money, according to prosecutors on Monday.

According to Queens prosecutors, in July 2024, on-duty policemen Justin McMillan, 27, and Justin Colon, 24, raided a Jackson Heights apartment and allegedly discovered a sex worker and a john in the act. McMillan then allegedly took money from her bag, touched her breast, and stroked her behind.

They returned to the 115h precinct without reporting the event or filling any paperwork, apparently because their bodycams were not active.

Before Queens Justice Jessica Earle-Gargan, the partners entered not guilty pleas to charges of burglary, petit theft, forcible touching, and official misconduct. Both of them were immediately placed on unpaid leave.

On July 19, 2024, McMillan from Atlantic Beach, Long Island, and Colon from Long Island City were put on foot patrol after receiving a 311 call regarding suspected prostitution occurring inside a residential building on 89th Street, close to Roosevelt Avenue, an infamous red-light district that is home to backroom bordellos.

According to the indictment, the police allegedly said, “I don’t see anything,” after arriving at the building and turning off their body-worn cameras. However, prosecutors claimed that as they stayed around the premises, a woman leaving through a side entrance approached them.

The woman was then allegedly persuaded to accompany McMillan and Colon inside the building before they grabbed her bag, threw its contents on the ground, and stole the keys to a locked door inside.

Prosecutors claimed that the two officers returned to the residence on 89th Street eight hours after leaving the building and continuing their patrol without reporting back on the call.

According to the indictment, McMillan and Colon, who were still on duty and had their body cameras turned off, discovered a sex worker with a male customer who ran away at the first sign of the cops.

Prosecutors claimed that McMillan, who was assigned to the 115th precinct in October 2023, molested the woman in her purse before she ran out of the building and dialed 911.

Seven months prior to the alleged misbehavior, in January 2024, Colon was assigned to the 115h precinct after enrolling in the police academy in July 2023.

Following the discovery of the alleged misbehavior by the NYPD’s Internal Affairs Bureau prior to its transfer to the Queens District Attorney’s office, McMillan and Colon were placed on modified duty in August 2024.

“We hold our officers to the highest standard of professionalism and integrity, and failing to meet that standard is disqualifying,” Police Commissioner Jessica S. Tisch said in a statement. “Let me be perfectly clear: Any officer who violates their oath will be investigated, exposed, and held fully accountable. That standard will never change.”

The Post revealed that Roosevelt Avenue was home to a flourishing underground sex market known as the “Market of Sweethearts.”

A dozen brothels masquerading as massage parlors were busted by the NYPD in January 2024 after receiving “allegations of illegal prostitution activity” in the region.

If found guilty of the most serious accusations, both cops could spend up to 15 years behind bars.

“The allegations in this case are an affront to the shield worn by the countless police officers who serve and protect the residents of this city,” Queens District Attorney Melinda Katz said in a statement.

On April 28, they were told to appear in court again.
