Man Thrown in Jail after 20 years and 2 Mistrials in Sexual Assault Case in Dayton
A Dayton man has been sentenced to nearly three decades in prison for sexually assaulting three girls over 20 years ago, following two mistrials.
Mack Deveron Perry, 49, received a sentence of 29½ years in prison from Montgomery County Common Pleas Judge Kimberly Melnick on Tuesday. A jury delivered verdicts on May 1, finding the defendant guilty of rape, eight counts of gross sexual imposition, and five counts of disseminating matter harmful to juveniles. The victims in these cases were all girls under the age of 13.
Perry was unable to be present for the verdict as he experienced chest pains and was subsequently taken to a local hospital, as reported by the Montgomery County Prosecutor’s Office. It was discovered that he had been taken into custody when a check of the Montgomery County Jail inmate roster revealed his presence, contradicting previous beliefs.
Perry had experienced chest pains and was hospitalized on the day of jury selection for his first two trials in February and April 1. As a result, Melnick declared mistrials on both occasions.
An investigation conducted by the Dayton Police Department revealed that he was involved in the delayed reporting of sexual assaults against three women. The incidents occurred between 2000 and 2003, when the victims were 27, 28, and 29 years old. The prosecutor’s office announced his indictment in January 2023.
On Tuesday, Melnick also classified Perry as a sexually oriented offender, meaning he will need to register annually for 10 years after his release. The crimes took place before the implementation of the current Tier I, II, or III system, as per the Adam Walsh Act.
