Man Found Guilty of Device Fraud Sentenced 12 Months of Probation in Pittsburgh

Hector Ofelio Podio Gutierrez, 31, of Las Vegas, Nevada, was found guilty of conspiring to commit access device fraud and was recently sentenced to 12 months of probation, which includes six months of home confinement.

Podio Gutierrez entered a guilty plea in July 2023 for his involvement in a conspiracy that used fictitious credit cards encoded with bank account credentials that had been stolen.

In December 2017, Podio Gutierrez and Yoandy Pou Torres, his co-defendant, engaged in fraudulent activities by creating counterfeit credit cards using an encoding device.

The two used fake credit cards to buy gift cards totaling more than $382,000, spending roughly $170,000 at Sam’s Club locations in the Pittsburgh region and the remaining sum in Florida and California.
