Indiana Judge Releases Mother after She Smothered her Daughter to Death while High on Meth

Indianapolis, IN: An Indiana mother was acquitted by a judge despite her alleged confession of smothering her 2-month-old baby girl while under the influence of meth.

Dacia Lacey has been charged by the Marion County Prosecutor’s Office in Indianapolis with neglect of a dependent resulting in death.

According to a probable cause affidavit, Lacey stated that in August 2022, she placed her 2-month-old Alona face down on the couch between cushions due to her persistent crying. Judge Mark Stoner has ruled Lacey as not guilty following a thorough three-day bench trial, according to court records.

“You may not be entirely innocent, but the state’s charges against you may not fully reflect your guilt,” Stoner said, as reported by local NBC affiliate WHTR.

Stoner criticized Lacey for displaying poor judgment. This is an unfortunate situation that arises from inadequate parenting. Certain actions will always be off-limits. According to reports, Stoner emphasized the importance of not using drugs while having custody of one’s children.

Based on the probable cause affidavit, Lacey initially informed the authorities that Alona’s passing occurred when she accidentally smothered her while playing together on the couch. She stated that she was cooking for her other children in a separate room and getting ready for a visit to the laundromat.

Upon her return, she discovered Alona lying motionless beneath a blanket and pillow. Upon questioning, Lacey’s 3-year-old daughter burst into tears, revealing what had occurred.

Lacey informed the detectives that she was uncertain about the events but believed it to be an unintentional incident. A few days following the incident, the girlfriend of Alona’s father reached out to detectives via email, sharing that the 3-year-old had made an unexpected statement regarding the event.

According to the affidavit, the girl reported that her mother covered Alona’s face with a pillow due to her crying.

However, according to the affidavit, the interview with the 3-year-old and investigators did not yield any useful information. The autopsy findings were inconclusive regarding the baby’s cause of death, leaving it undetermined.

Approximately three weeks following Alona’s passing, a drug screening revealed the presence of methamphetamine in Lacey’s system on that particular day.

Supposedly, she confessed to consuming a “rolling pill” that she believed was Molly but turned out to be meth, just days before Alona’s passing.

According to the affidavit, Lacey expressed her frustration with Alona’s continuous crying, stating that she was still feeling the effects of being high.

Stoner gained significant attention recently for his decision to sentence Elliahs Dorsey to time served in the case of Officer Breann Leath’s shooting death in 2020. According to court records, Stoner was given an additional 25 years for the attempted murder of Dorsey’s girlfriend. Prosecutors were seeking a sentence exceeding 60 years.
