Family Protest against the Potential Release of Man who killed a Boy

Logan: “Keep Edward in jail! Keep Edward in jail!” The family of Javier Velez protested outside the Atlantic County Criminal Court Complex to keep the man charged with Javier’s death in jail.

His mother, Kaylah Smith brought Javier’s ashes to make a powerful point. She was joined by two dozen people.

Edward Johnston, 25, is charged with the aggravated manslaughter. He crashed into a parked car in which Javier was sleeping. The Egg Harbor City resident went off the road on the White Horse Pike and crashed into the parked car, as per the investigators.

According to Absecon Police, Javier was sleeping in the car around 3:25 pm on July 23rd. His father was packing to head back home after a fishing trip.

The court ordered Edward to be released from custody as the next hearing approaches. The family was taken aback by the order. Johnston has had several motor vehicle summonses in the past as well.

“We’re here fighting for justice and we need it the same way how at the snap of a finger, my kid was gone. The same results need to be done with the killer,” said Javier’s father Orlando Velez.

The protest prompted a response from Senator Vince Polistina. He said that legislation is required that would change the way such cases are handled.

“That would require the presumption of detention anytime you have a situation like this,” he said. “This is somebody who is now alleged to be going 107mph, to be under the influence of drugs and alcohol,” said Senator Polistina.

The family was left heartbroken when Javier, who then recently turned 8, passed away in the crash. Now the release order amplified their pain.
