New York City, NY: The parents of an 8-year-old boy were described by the grand jury as Monsters after they locked their 8-year-old son in the garage with sub-zero temperatures in a New York City residence.

The ex-NYPD officer’s 8-year-old son died, and the DA says the child protection system is to blame.

A new grand jury report says that the child safety system kept quiet about the years of abuse that autistic boy Thomas Valva went through. His ex-NYPD cop dad and stepmom were found guilty of murder in his freezing death.

The 8-year-old boy was being abused for a long time, but complaints were kept secret until it was too late because of strict privacy rules in New York. The claims were seen as “unfounded” and private, according to a 75-page report approved by Suffolk County District Attorney Ray Tierney.

Tierney said that the Child Protective Services Division of the county’s Department of Social Services kept the reports secret even after Michael Valva and his wife Angela Polina were found guilty. This was because the grand jury was trying to figure out why so many signs of abuse of Thomas and his brother went unnoticed.

Tierney told the press on Thursday, “These boys had been in pain for far too long, and nothing was done to help them despite 11 reports to CPS.”

Thomas Valva, 8, was found not breathing on January 17, 2020, in the morning. He had been locked in his parents’ garage overnight in very cold weather and had died.

The boy died in a cold garage overnight without a blanket or any other safety gear. Valva, 44, and Polina, 46, were found guilty of his tragic death in 2020.

Authorities say Thomas died of hypothermia after being out in the cold for up to 16 hours, with temperatures dropping below 20 degrees.

Prosecutors said that the brothers’ exile to the garage was the last step in a pattern of abuse. At their trial, the director of Thomas’ school said that teachers had called CPS many times because they were worried the brothers were being abused at home.

“I will beat them until they bleed,” Valva texted Polina about the two boys one time. “That’s the only thing that works.”

Judges gave Valva and Polina sentences of 25 years to life in state jail. Polina was called a “monster mom” in court.

Officials at the school said the boys were often dirty and bruised, and they were so hungry that teachers caught them scrounging for food on the floor.

A firefighter who helped save little Thomas said in court that the ex-cop had “no emotion, no sense of concern” for his son when first responders arrived at the Center Moriches home.

Valva said that his son was dead when he found him because the boy had hit his head on a door frame.

Tierney called for the grand jury because people were angry about the case. The grand jury looked into the boy’s pointless death for six months, but they ran into problems with CPS every step of the way.

The state law lets these things be kept secret from the public, the police, and even a grand jury that is looking into the death of a child, the prosecutor said in a statement. “This law is wrong and needs to be changed.” We have a terrible system in place to protect our children right now.

In this case, it’s unfair that no one, not even a district attorney, superior court judge, or state advisory board, can get old reports that CPS has wrongly and randomly called “unfounded,” the statement said.

“Now, about the reports before Thomas’ death—shockingly, 10 of the 11 reports of child abuse and maltreatment made by teachers and staff at East Moriches Elementary School before Thomas’ death were found to be false by Suffolk County CPS,” he told reporters.

Tierney said, “This is the most important thing to learn from this grand jury’s report.” “That means we don’t know why Suffolk County CPS said those reports were false, and we don’t know what, if any, steps he took to probe them.”

Tierney said that the agency “effectively thwarted” efforts to find the answer which were looked into by the grand jury.

The study suggested several ways to fix the law. For example, it said that CPS reports on suspected child abuse should not be kept secret so that they can be looked into by a grand jury or the police. It also suggested new rules for when investigators can see reports that are not based on evidence.
