California faces a Lawsuit from Parents over the title of a Transgender Ballot Initiative they Deem Misleading

A parents’ rights organization has filed a lawsuit against the attorney general of California for what they believe is a biased classification of their ballot proposal.

A lawsuit was filed by the parent activist group Protect Kids California against California Attorney General Rob Bonta regarding the group’s ballot initiative. The initiative aims to require schools to notify parents if children request to be treated as a different gender, prevent transgender females from participating in female sports, and mandate that students use school facilities consistent with their birth genders.

“No matter the viewpoint or details of a ballot initiative, Californians deserve a fair title and summary of that initiative as part of their fundamental political expression,” stated Emily Rae, senior counsel at the Liberty Justice Center, which co-filed the lawsuit against Bonta. “In the end, Rob Bonta must fulfill his responsibilities as Attorney General for the people of California by handling the matter without any bias or prejudice.”

PKC’s ballot initiative is leading the current wave of statewide parental worries about transgender policy in education and sports. During the first phase of their initiative, PKC referenced a Rasmussen poll that revealed 68% of California voters, with 65% of Democrats, backing schools informing parents if their child identifies with a different gender than their biological sex.

According to a recent Gallup poll, the majority of Republicans, a significant percentage of independents, and a smaller portion of Democrats support transgender athletes playing on teams corresponding to their birth gender. The group highlighted a Harvard/Harris poll that revealed an equal number of voters oppose the use of puberty blockers for minors.

Attorney General Bonta has consistently expressed his opposition to Protect Kids California’s initiative. They had no hope of getting a fair title and summary. Furthermore, Bonta faces a significant conflict of interest as he is involved as a plaintiff, a defendant, and an amicus in various lawsuits related to the issues,” stated Erin Friday, Esq, a member of PKC’s executive team.

California school districts have implemented new policies mandating that parents be informed of any changes in their child’s gender, leading to multiple legal battles. Bonta has been actively opposing the school board ordinances, providing public support through his office and submitting amicus briefs in cases challenging school boards.

As per the California Secretary of State, this initiative would each need to collect 546,651 signatures to be on the November 2024 ballot.

On another note, a recent Public Policy Institute of California survey revealed that 70% of potential California voters are in favor of the Equality Act. This national bill from 2021 aimed to prohibit discrimination in various areas based on sex, sexual orientation, and gender identity. If the federal Equality Act were to be approved, it would have overridden any state or local laws regarding transgender issues.
