A guy who had been linked to a 40-year-old Miami-Dade rape case by a DNA test was returned to detention on Friday after a drug test.

And his victim, who had previously told NBC6 Investigates that she was dissatisfied when he was permitted to plead guilty to a lesser charge last year, said she was relieved to see that prosecutors kept their word and are now willing to insist he serve years in jail.

Gustavo Rivero was sent to jail after a drug test for cocaine, the same drug his victim said Rivero provided her in January 1985 on the night she reported being brought to an open field and raped.

Mari Jimenez, assistant state attorney, wasted no time in asking Miami-Dade Circuit Judge Ariel Rodriguez what to do with Rivero, who is now accused of violating his probation.

“Judge, at this time the state requests he be taken into custody pursuant to the violent career criminal statute,” she added, citing a law that Rodriguez claimed forced him to jail Rivero for the time being at the state’s request.

Rivero was 24 when he and an unidentified accomplice left what was then Dave’s Bar in Miami Beach with a woman who thought she was going to a party but ended up battling for her life.

“They took me out there to kill me,” Nancy Crowden stated in an interview last October. “I know that.”
