$4 Million Settlement To Lady Who Had Sponge Left Inside Her Abdomen in Phoenix

Phoenix; Arizona: A woman was awarded $4 million in Arizona Superior Court on Wednesday after a laparotomy sponge was left inside her abdomen during a c-section procedure at Banner University Medical Center. The verdict was based on court documents and a press release issued by The Mercaldo Law Firm.

The law firm, which represented the woman, stated in the release that the sponge resulted in significant complications and prolonged distress.

Banner Hospital acknowledged that the presence of a sponge in a patient goes against the expected level of care for obstetricians. However, they contested whether their actions directly resulted in the patient’s injuries.

“Our client courageously pursued justice, seeking accountability for both physical injuries and emotional distress caused by this preventable error,” the press release said. “The legal team at Mercaldo Law Firm meticulously presented the evidence, demonstrating the clear negligence of the medical staff involved in the procedure and the full extent of the injuries they caused.”
